Welcome to Hullo Mobility! These Terms of Service ("Terms") govern your use of our platform, mobile applications, website, and related services (collectively, "Services"). By accessing or using our Services, you agree to comply with and be bound by these Terms. If you do not agree to these Terms, please do not use our Services.
2. Definitions
- "User" refers to any individual who accesses or uses our Services.
- "Driver" refers to a registered individual who offers ride services via our platform.
- "Passenger" refers to a registered individual requesting a ride through our platform.
- "Platform" refers to the Hullo Mobility mobile application and any associated websites.
3. Registration and Account Creation
To use our Services, you must create an account. When creating your account, you agree to provide accurate, up-to-date information and to maintain the confidentiality of your login credentials. You are responsible for all activities that occur under your account.
- You agree to notify us immediately of any unauthorized use of your account.
- You may not impersonate another person or entity, nor mislead others with false information.
4. Use of the Services
You agree to use our platform in accordance with applicable laws, rules, and regulations, and you will not engage in the following prohibited activities:
- Fraudulent or Malicious Activities: Engaging in activities that are fraudulent, abusive, or illegal, such as impersonating a driver or passenger, submitting false trip information, or violating traffic laws.
- Abuse of Platform: Using the platform in a way that interferes with its functionality or undermines the safety, security, or reputation of the platform, other users, or the general public.
5. Ride Requests
- Passenger Responsibilities: As a passenger, you agree to be present at the agreed pick-up location, respect the driver's time, and pay the agreed-upon fare for your ride. You must also comply with the driver's instructions and cooperate for a smooth experience.
- Driver Responsibilities: As a driver, you agree to provide a safe, timely, and professional service. You must comply with local laws, ensure the vehicle is safe, and maintain proper documentation (e.g., valid driver's license, insurance).
- Ride Cancellation: Both passengers and drivers can cancel rides under certain circumstances. If you cancel after a certain time period, you may be subject to a cancellation fee.
6. Payment Terms
Hullo Mobility uses third-party payment processors for transactions. You agree to provide accurate payment details and authorize payments for rides, including any additional fees or charges that may apply (e.g., cancellation fees, surge pricing).
- No Direct Card Information: We do not collect or store payment card information. All transactions are handled through secure third-party payment processors.
- Payment Disputes: In the case of a payment dispute, we encourage users to first attempt to resolve the issue directly with the other party involved. If the dispute remains unresolved, we will attempt to mediate and may charge additional fees for handling such disputes.
7. Fees and Charges
Hullo Mobility charges service fees, and these fees may vary depending on the service type, location, and other factors (e.g., surge pricing). All fees are disclosed before you confirm the ride.
You are responsible for paying the total fare, including taxes, fees, and any additional charges (such as for waiting time or cancellations).
8. User Conduct and Responsibilities
You agree to:
- Treat all users, including drivers and passengers, with respect and courtesy.
- Not engage in any abusive, discriminatory, or unsafe behavior.
- Comply with all applicable local, state, or national laws, including traffic regulations and driving laws.
- Refrain from using the platform while under the influence of alcohol, drugs, or any other substances that could impair your ability to drive or make sound decisions.
9. Data Protection and Privacy
By using our Services, you agree to the collection, use, and sharing of your data as outlined in our [Privacy Policy]. We take the protection of your personal data seriously and implement measures to safeguard it.
10. Limitation of Liability
Hullo Mobility is a platform connecting drivers with passengers. We do not directly provide the transportation services and are not liable for any damages, losses, injuries, or accidents that may occur during a ride. Our liability is limited to the extent permissible by law, and we do not guarantee the safety or reliability of any ride.
- Indemnification: You agree to indemnify and hold Hullo Mobility harmless from any claims, damages, or losses arising out of your use of the platform or any interactions with other users.
11. Dispute Resolution and Governing Law
- Arbitration: Any disputes, claims, or controversies arising out of or relating to these Terms or the Services shall be resolved through binding arbitration in accordance with the rules
- Governing Law: These Terms shall be governed by and construed in accordance with the laws of Uganda.
12. Termination
We reserve the right to suspend or terminate your account if you violate these Terms of Service, engage in unlawful activities, or otherwise misuse the platform. Upon termination, you will no longer have access to our Services, but your obligations, including payment obligations, will remain in effect.
13. Modifications to the Terms
Hullo Mobility reserves the right to update or modify these Terms of Service at any time. Any changes will be communicated via notifications within the app or through email. By continuing to use our Services after such updates, you agree to the revised Terms.
